Dongzhou District Court: Eight corn fields were tragically harmed by drugs, and the "court linkage" mediated the dispute

As the saying goes, "there are thousands of agricultural production roads, and scientific medicine is the first", scientific spraying of pesticides is to prevent and control pests and diseases, and once used improperly, it will cause irreparable impact. On June 26, the Zhangdang Court of the Dongzhou District People's Court and the Zhangdang (Town) Judicial Office successfully mediated a case of compensation for crop damage caused by spraying pesticides by 8 farmers against the defendant, which was concluded in less than 10 days from the filing to the conclusion of the case, which not only recovered the losses of the parties to the greatest extent, but also prevented the intensification of the conflict and maintained a harmonious and stable neighborhood relationship between the villagers.

It turned out that from May 23 to 30, 2024, shortly after the defendant sprayed pesticides (Roundup) on the ridges of his rice field, eight farmers in the vicinity of the pesticide spraying land found that the corn seedlings near the roadside had partially died.

After understanding the facts of the case, the presiding judge Pu Shi considered that the number of plaintiffs in this case was relatively large, and in order to fundamentally resolve the dispute and prevent the conflict from intensifying, he immediately went to the damaged cornfield with the Zhangdang (Town) Judicial Office to inspect the scene at the same time. Judge Pu Shi and the director of the judicial office mediated the parties to the dispute based on the principle of mediation to promote peace.

Everyone's corn was sown together, and the seeds, pesticides, and sowing days were all the same, and as long as the corn seedlings were close to the defendant's house, they were damaged, and those that were far away were normal and healthy, so it was caused by the defendant's spraying.

In view of the fierce attitude of the two parties, in the subsequent trial process, Judge Pu Shi adopted a "back-to-back" approach, mediating and explaining the law to the parties respectively. The members of the collegial panel carefully explained to the plaintiff the method of collecting evidence of drug hazards, and informed that if the application for appraisal requires a professional organization to conduct an on-site inspection, it will not only take a long waiting time, but also greatly increase the cost of litigation, and it is unknown whether the final appraisal conclusion can be reached. In the face of the defendant, Judge Pu Shi proceeded from the neighborhood and hometown, patiently persuaded and made reasonable suggestions on the amount of compensation.

In the end, with the unremitting efforts of the presiding judge and the judicial office, the defendant agreed to voluntarily pay the plaintiffs Qiu 200 yuan, Xie 600 yuan, Xu 1,000 yuan and other total 4,100 yuan on July 10, 2024 in order to get along with the plaintiffs and produce effectively. The dispute has come to a successful conclusion.

The Zhangdang Court of the Dongzhou District People's Court will further practice the "Fengqiao Experience" in the new era, actively explore the working mechanism of "court-office linkage", and truly realize that small matters do not leave the village, major matters do not leave the town, conflicts are not handed over, and disputes are resolved locally. Continue to carry forward the work concept of "I do practical things for the masses", continue to win the trust of the people, and go all out to respond to the people's new demands and expectations for the work of the people's courts.
