On September 29, the Provincial Market Supervision Bureau released the food safety "elderly care" action and the typical case of special clean-up and rectification action in the health food industry.

In accordance with the work deployment of the State Administration of Market Supervision and the Provincial Market Supervision Bureau, the provincial market supervision system actively carried out the practical activities of "I do practical things for the masses", combined with the actual conditions of our province, and jointly with relevant departments to carry out the province's food safety "elderly care" action and the special clean-up and rectification of the health food industry, severely cracked down on illegal production and operation, false publicity and fraud in the food and health food industry, and investigated and handled a number of cases.

1. False publicity case of new retail daily service station in Linxiang City

On May 21, 2021, the Yueyang Linxiang Municipal Market Supervision and Administration Bureau received consumer complaints and inspected the meeting and sales activity sites of the new retail daily service station in Linxiang City, and after verification, the parties claimed that the ordinary foods and health foods they operated had the function of preventing and treating diseases, and the total sales value of the goods was 75,300 yuan. The parties' conduct violated the first paragraph of Article 8 of the Anti-Unfair Competition Law of the People's Republic of China. On June 10, 2021, the Market Supervision and Administration Bureau of Linxiang City, Yueyang City, in accordance with Article 23 of the Administrative Punishment Law of the People's Republic of China and Article 20 of the Anti-Unfair Competition Law of the People's Republic of China, ordered the parties concerned to immediately stop the illegal acts and imposed a fine of 320,000 yuan.

Second, Changde Quanyou Fenghui Biotechnology Co., Ltd. operated a food case with added drugs

On June 12, 2020, the Changde Municipal Market Supervision and Administration Bureau inspected "Changde Quanyou Fenghui Biotechnology Co., Ltd." and after testing the food it operated, "Ailangshen Starch Saced Maca Yellow Essence Powder", the results showed that it contained the pharmaceutical ingredient "tadalafil". After verification, the company's sales amount was 23625.65 yuan, and the illegal income was 13109 yuan. The parties' behavior in dealing in food with added drugs violated the relevant provisions of Articles 34 and 38 of the Food Safety Law of the People's Republic of China, and the Changde Municipal Market Supervision and Administration Bureau imposed the following penalties on the parties in accordance with the relevant provisions of Articles 123 and 126 of the Food Safety Law of the People's Republic of China: 1. Warning; 2. Confiscation of 6153 boxes (bottles) of food "Ailangshen Starch Sac containing Maca Yellow Essence Powder" for the added drugs; 3. Confiscation of illegal gains of 13109 yuan. It was also fined 631455 yuan, for a total of 644564 yuan.

3. Xiangyin County Yang nai Shijia milk powder store false publicity case

On September 25, 2020, when the Market Supervision and Administration Bureau of Xiangyin County of Yueyang City inspected the Yangnai Shijia Milk Powder Store in Xiangyin County, it was found that when the parties promoted the ordinary food of "Yangnai Shijia Sheep Bone Marrow Collagen Peptide", they claimed that it had the effect of preventing and treating diseases, which violated the provisions of Article 8, Paragraph 1 of the Anti-Unfair Competition Law of the People's Republic of China, and deceived and misled consumers. In accordance with the relevant provisions of Article 23 of the Administrative Punishment Law of the People's Republic of China and Article 20 of the Anti-Unfair Competition Law of the People's Republic of China, the Xiangyin County Market Supervision and Administration Bureau ordered the parties concerned to correct the illegal acts and imposed a fine of 200,000 yuan.

Fourth, the people of Louxing District of Loudi City took the purchase of health food that exceeded the shelf life period of the supermarket

On June 17, 2021, when the Market Supervision and Administration Bureau of Louxing District of Loudi City inspected the people's shopping supermarket in Louxing District, Loudi City, it was found that the health food "Shenli Ant Wine" (2 bottles) operated by the supermarket had exceeded the shelf life, and after verification, the supermarket had sold 8 bottles of "Shenli Ant Wine" that exceeded the shelf life, with a total sales amount of 2384 yuan, and its behavior violated the provisions of Item (10) of The First Paragraph of Article 34 of the Food Safety Law of the People's Republic of China. Article 124, paragraph 1, item (5) of the Food Safety Law of the People's Republic of China and article 14, paragraph 1, item (2) of the Measures for the Implementation of the Discretionary Power of Administrative Penalties for Market Supervision and Management in Hunan Province (for Trial Implementation) impose the following penalties on the parties: 1. Confiscate 2 bottles of Shenli Ant Wine that exceed the shelf life; 2. Fine 20,000 yuan.

5. An e-commerce company in Nanxian County, Yiyang City, organized and planned a case of pyramid schemes for food and health food

On April 22, 2020, the Market Supervision and Administration Bureau of Nan County, Yiyang City, received a consumer complaint and inspected the marketing premises of an e-commerce company located in thatched street town, Nan County. After verification, the members of the company exaggerated the efficacy of food and health food, and developed others to become members of the company, and the way in which they developed members constituted the organization and planning of pyramid schemes under article 7 (2) and (3) of the Prohibition of Pyramid Schemes Ordinance. On July 17, 2020, the Market Supervision and Administration Bureau of Nanxian County, Yiyang City, in accordance with the relevant provisions of Article 24, Paragraph 1 of the Regulations on prohibition of pyramid schemes and Article 27 of the Administrative Punishment Law of the People's Republic of China, ordered the parties concerned to immediately stop the illegal acts and imposed a fine of 500,000 yuan.
