In October 2020, Zhang Xi, his bridesmaid Chen Yuan (pseudonym) and others stayed at a hotel in Xiao County after attending a wedding. Chen Yuan was resting in a room in the hotel due to physical discomfort, Zhang Xi called a cleaner through the front desk of the hotel, opened the room where Chen Yuan was staying, kissed Chen Yuan, who was sleeping, and stroked his chest.
Chen Yuan was awakened and resisted, but Zhang Xi ignored his resistance and forcibly took off Chen Yuan's shorts and underwear to his calves, and after Chen Yuan brought his clothes and pants back, Zhang Xi still caressed the sensitive parts of his chest and lower body. Shortly after the incident, Zhang Xi took the initiative to surrender to the Xiao County Public Security Bureau.
The Xiao County People's Procuratorate of Anhui Province held that defendant Zhang Xi had violated the first paragraph of article 237 of the Criminal Law of the People's Republic of China by forcibly molesting a woman by violent means, the facts of the crime were clear, the evidence was credible and sufficient, and he should be investigated for criminal responsibility for the crime of forced indecency. Defendant Zhang Xi who admits guilt and accepts punishment may be given a lenient disposition in accordance with article 15 of the Criminal Procedure Law of the People's Republic of China. In accordance with the provisions of Article 176 of the Criminal Procedure Law of the People's Republic of China, if a public prosecution is initiated, please sentence it in accordance with law.
It is understood that the case was investigated by the Xiao County Public Security Bureau and transferred to the Xiao County People's Procuratorate for prosecution on May 19, 2021, on the suspicion of forced indecency by defendant Zhang Xi. Zhang Xi had no objection to the facts and evidence of the alleged crime and voluntarily pleaded guilty and accepted punishment.
