The court found that in January 2019, the defendant opened a casino using the "QinHuai Mahjong" APP. Defendant Yu established a group of relatives and friends called "Little Fisherman's Club" in the "QinHuai Mahjong" APP and recruited players to gamble by playing Yichun Mahjong. At the end of each round, the defendant will draw $4 from the gambling funds at a certain club. By the time of the incident, the defendant had recruited more than 190 gamblers and made a total profit of 148344 yuan. During this period, defendant Zhou knew that he used the "QinHuai Mahjong" APP to open a casino, but still sold a room card of 26,800 yuan to defendant Yu and profited from it.
After the incident, the defendants Yu X and Zhou X respectively handed over 100,000 yuan for public security and did not collect money.
At trial, the court held that the defendant used the Internet to open a club for others to gamble and make profits from it for the purpose of making a profit, and the defendant Zhou knew that the defendant had set up a casino on a certain network and sold a house card to the defendant to make a profit from it, all of which were serious circumstances, and his conduct constituted the crime of opening a casino. The prosecution's allegations were established. Is a joint offence. Among them, the defendant plays the main role in Yu X and is the main offender; the defendant Zhou X plays a secondary role and is an accessory, and the punishment is mitigated according to law. In view of the fact that the defendants can truthfully confess their crimes after the arrival of mr. and Mrs. Zhou, are willing to accept punishment, and have handed over their illegal gains, they may be given a lenient punishment.
