Red Net Moment, November 5 (Correspondent Tan Zefei) On November 3, the Yanling County People's Court held a public trial and convicted defendant Huang X of the crime of endangering precious and endangered wild animals, illegal hunting, and illegal manufacturing of firearms, and jointly executed the four-year prison sentence and fined 10,000 yuan. It also demanded that defendant Huang Moumou compensate 77,437.55 yuan for the loss of state resources within ten days after the judgment took effect, and apologize to the public through the news media at or above the county level.
In 2012, defendant Huang Moumou purchased 65 suspected sambar deer leg bones for more than 2,000 yuan at a floor stall in an Anren County Market in Chenzhou and stored them in his freezer for pre-brewing wine. Later, it was forensically identified as 2 Chinese iguanas and 63 were sambar deer, all of which were national second-level protected wild animals, with a total hunting value of 1737.35 yuan. Later, from 2017 to 2020, 1 sambar deer, one rock sheep and one macaque monkey was hunted in the game reserve, which was later identified as a national second-level protected wild animal. In September 2020, Huang Moumou did not apply for a hunting license, and hunted a wild boar during the hunting ban period in the "thin pit" mountain farm of Gualiao Village, Shidu Town, which belongs to the game ban area, using a combination of alarms, trap clips and rope sets, and hunted it and brought it home for consumption. Later, the wild boar was identified as a "beneficial terrestrial wild animal protected by the state or with important economic and scientific research value". Moreover, during 2013, Huang moumou asked others to help him make a shotgun, and then cut and welded by others to assemble a gun, which was later identified as a gun that fired metal projectiles with gunpowder as the power.
After trial, the Yanling court held that defendant Huang X's illegal hunting, killing, and illegal purchase of rare and endangered wild animals under key national protection and their products had constituted the crime of endangering precious and endangered wild animals; his behavior had constituted the crime of illegally manufacturing firearms by using prohibited tools and methods to hunt in a hunting area or during the no-hunting period, and the circumstances were serious, and his conduct had constituted the crime of illegal hunting; and his behavior had constituted the crime of illegally manufacturing a firearm without the approval of the relevant state departments.
The Yanling court openly heard and pronounced judgment on the case, declaring war on precious and endangered wild animals with a sonorous hammer, providing a strong judicial guarantee for protecting the ecological environment and maintaining the development of biodiversity. At the same time, it has also played a certain warning and educational role in curbing such illegal and criminal incidents and improving the awareness of wildlife protection among the whole people.
