After satisfying the appetite of the pilot film for three days, "Executive Judge" finally ushered in the premiere, as an executive officer of the grassroots court, he naturally couldn't wait to open the "trial", the overall plot is compact and real, vividly showing the daily life of the enforcement work.
The executive judge actually belongs to a special group in the court, if you see that as soon as you go to work in the morning, you will change into a uniform, pick up a briefcase full of execution materials and rush downstairs, and answer the phone while walking, "Wait for me, arrive soon" The scene, no need to guess, it must be the judges of the Executive Bureau, they are wearing legal robes, but rarely knock on the gavel, their figures are not in the courtroom, but on the way to execution, this drama unveils the "mystery" to the executive judge, so that more people can understand the enforcement work.
In order to solve the problem of "difficult enforcement, few case-handling personnel, and many backlog cases" in enforcement, the Qinggang Court in the play dispatched an excellent young judge of the criminal court, Qi Lin (played by Luo Jin), to the enforcement court for rotation. There are so many things to do in the implementation of the law, but in fact, it can test the comprehensive ability of judges.
I remember when I first joined the Executive Bureau, I listened to an enforcement judge who had been fighting on the front line of enforcement for more than 20 years share his experience, and I still remember the three abilities that he summarized for enforcement officers and police. These three necessary executive abilities are actually the implementation of the three-word formula: "steady, accurate and fast", "stable" means "stable mentality", "accurate" means "knowing the standard", and "fast" means "fast response".
"Stable mentality" means that in the course of enforcement, the enforcement judge must face all kinds of unexpected problems, and the enforcement judge must have a strong psychological quality.
In the play, Judge Qi Lin's aunt Qi Runyu's hotel was forcibly vacated because of her son Fang Qiang's implication and needed to be vacated, Qi Runyu couldn't accept it for a while, picked up a broom to prevent the court from posting the auction announcement, and in the face of the sudden tense execution scene, the executive judge Chu Yun (played by Yang Zishan) always remained calm, first took out evidence to explain the law and reason, and informed him that he could raise an outsider's objection to the court. Later, he also realized his mistakes under Qi Lin's education. Because the vital interests involved in the enforcement process, the parties are easily emotional and act excessively, and the enforcement judge needs to have the ability to be fearless in the face of danger, because wearing a uniform no longer represents an individual, but represents the judicial power behind it. Of course, the "stable mentality" is ultimately due to the familiarity and application of the implementation norms, the implementation is not "heavy results, light procedures", for excessive implementation, chaotic implementation needs to be strictly prohibited, the implementation of not only need "strength", but also need to take into account the "temperature", only the implementation of the normative use of the chest, the heart has confidence, the mentality is naturally "stable".
"Knowing the criterion" means that there are many risk points involved in enforcement, and the risk of integrity is large, and the enforcement judge must know the bottom line and keep the cordon.
In the play, before Judge Qi Lin was transferred from the Criminal Court to the Executive Bureau, he heard that Zhao Lingnan, a college classmate he hadn't seen for many years, invited him to dinner, and happily went to the appointment, but he didn't expect that there was also Zhou Zhi, the father of the defendant Zhou Youmin who was trying the case, Qi Lin instantly understood the intention of this dinner, so he left the table angrily. Unexpectedly, the next day, another trustee, Dong Ming, still privately asked Qi Lin to withdraw his strong grip on Qi Lin's aunt's house as a bait in exchange for a reduced punishment for the defendant Zhou Youmin, but Qi Lin still categorically refused, and reported the relevant situation to the leadership, and finally Zhou Youmin's case was judged in accordance with the law. Judges have judicial power, and if they are used well, they can benefit the society, and if they are not used well, they may endanger the people and cut themselves off, and because the enforcement work directly involves money and property, the risk of integrity is higher, and it is easier to be hunted.
"Quick response" refers to the entanglement of various legal and factual relationships in the course of enforcement, and the enforcement judge needs to be bold and careful and quick to respond.
In the case of the execution of Li Ren's arrears by Judge Chu Yun's team in the play, the person subject to execution, Li Ren, is a typical "old lai", who still gambled in Macau through illegal channels after being restricted from leaving the country. Faced with such a critical situation, Judge Chu Yun immediately arranged emergency measures such as fire first aid inflatable cushions, and after a long confrontation, finally due to the physical exhaustion of the person subject to enforcement, the enforcement police and the bailiff cooperated to quickly pull him up and take him to a safe place. In addition to a detailed and thorough enforcement plan, the enforcement judge also needs to be improvised, and while fighting wits and courage with the "old lai", he also needs to find property clues through clues and solve enforcement problems.
Enforcement, as the last mile to maintain fairness and justice, is a key step in turning "paper rights" into "real money", and it is also a specific link to enhance the people's sense of access to justice and satisfaction. Enforcement requires perseverance and courage, and the task of "effectively solving difficulties in enforcement" is arduous and the mission is glorious, but I believe that with the continuous improvement of various measures to "effectively solve difficulties in enforcement", we will use the least procedures, the shortest time, and the largest proportion to realize the rights and interests of the parties in winning the lawsuit. "Enforcement Judge" allows more people to understand the enforcement judge, and I hope that more people will understand the enforcement judge, and we will work together to make the effective judgment "sound on the ground" and make an enforcement contribution to creating a social environment of integrity and fraternity.
