In order to avoid penalties for traffic violations, some drivers choose to use other people's driver's license points to offset their own violations by buying points. Some criminals have taken a fancy to this "business opportunity" and acted as "scalpers" to organize others to buy and sell points for profit, and even developed apps to provide illegal services such as personnel introduction and puzzle forensics for "scalpers".
After the Shanghai Baoshan District Procuratorate initiated a public prosecution, a few days ago, 58 defendants involved in the case, including "scalpers" and developers of the Buyfen and SellingCent App, were sentenced for the crime of forging documents of state organs.
The "person" and "certificate" of the violation handler do not match
The system photo shows that the person involved in the traffic violation is a man, why is it a woman who comes to deal with the violation? In October 2022, the police of the Gucun Police Station of the Baoshan Branch of the Shanghai Municipal Public Security Bureau discovered this problem while handling business. The police immediately questioned the woman Li who handled the business, and reconfirmed the motor vehicle driver's license and motor vehicle driving license submitted by her (you need to carry two documents at the same time to deal with violations, of which the driver's license is to prove that you have driving qualifications, and the driving license is to prove the illegal vehicle information), and found that the motor vehicle driving license provided by Li only has content on the front, but the reverse is blank.
Under repeated questioning by the police, Li confessed that he was arranged by the "scalper" Wang to deduct points on behalf of others, and the motor vehicle driver's license was his own, but the motor vehicle driving license used was forged by Wang to prove that he had a relationship with the illegal vehicle. A few days later, the police arrested Wang in a residential house.
After Wang arrived at the case, he confessed that he was accosted by a "scalper" when he was dealing with violations in the traffic police brigade before, asking "whether you need to deduct points part-time". After Wang readily agreed, he entered a number of "traffic violation handling" groups and organized the introduction of others to buy and sell points. Wang introduced that he is looking for "buyers" and "sellers" through a social software applet, and the platform also has its own mapping function, which can forge the motor vehicle driving license of the "buyer", and he has forged more than 80 motor vehicle driving licenses through the platform.
The public security organs conducted an in-depth investigation into this social software applet. After five months of clue mining and data analysis, a criminal gang involving many places across the country, using the production of fake certificates as a means and implementing cross-provincial deduction points through intermediaries surfaced.
Research and development of the "driving license beautification" function to evade review
The main account of this social software applet is a network technology company founded by Yu. At the beginning of 2019, Yu founded the company, recruited about 10 employees, and developed an App that provides vehicle traffic violation information query services for "scalpers", car rental companies, and car renters. At the same time, the company simultaneously launched a social software mini-program with the same function as the App to facilitate multi-channel business expansion.
In order to optimize the function of the app, Yu established a group chat with active users. In the communication, it was learned that many "scalpers" have encountered the same problem - the original motor vehicle driving license is required to find someone to handle the deduction points, but most of the "scalpers" and traffic violation owners are in different places. Some car owners are only willing to let the "scalpers" print by themselves by sending photos, and the photos taken often have low pixels and reflective conditions, which are easy to be found by the auditors who handle the violation window.
After Yu learned about this situation, he started to think crookedly. In January 2021, Yu asked employees to rewrite the code of the App and developed a new function of "driving license beautification" on the basis of the original function. The "Driving License Beautification" function can imitate the real motor vehicle driving license to make a template, and preset the required text and seal in advance. After uploading the photos of the front and subpage of the motor vehicle driving license, the system will automatically recognize the text in the picture, set into the preset driving license template, and automatically generate an electronic scanned copy of the motor vehicle driving license stamped with the official seal of the local traffic management department. After the new feature was launched, it attracted a large number of "scalpers" to use and forward.
A single deduction business makes a profit of 100 yuan
At the same time as Wang, there were also a number of "scalpers". According to the "scalper" Chen, he also went to the traffic police brigade to deal with the modern deduction business when the violation was profitable, so he joined more than 10 group chats, and met customers who were only willing to send photos of motor vehicle driving licenses, so they made a fake motor vehicle driving license through the App.
After generating an electronic scan, Chen will go to a print shop to print it, then compare and crop it, and put on the blank driver's license holster he bought to pass it off as the real thing. In addition, Chen also helped other "scalpers" to operate forged driving licenses on the App and charged a certain "benefit fee".
According to Chen's confession, he made a profit of 30 yuan to 50 yuan per point for handling illegal deductions, an average of 6 points per order, and a profit of about 100 yuan per order except for others' shares.
After investigation, from June 2021 to January 2023, Chen Mougang handled 48 violation records for a fee, and another "scalper" Hu Mou who was brought to the case handled as many as 448 violation records.
The "driving license beautification" function developed by Yu's employees helped several "scalpers" generate more than 200,000 fake driving licenses, and illegally made more than 350,000 yuan; In order to obtain illegal benefits, 49 people, including Chen and Hu, acted as intermediaries for deducting points for motor vehicle violations and earned intermediary fees.
Fifty-eight people were sentenced for forging documents from state organs
After the case was transferred to the Baoshan District Procuratorate for review and prosecution, the procurator undertaking the case will handle different groups involved in the case, such as the boss and operation and maintenance team of the platform involved in the production and handling of fake certificates, the intermediary of withholding points, the personnel of the printing shop involved in the case, the owner of the vehicle in violation of regulations, and the personnel withholding points, according to the degree of participation. After examination, the court found that Yu and his company staff, "scalpers" Wang, Chen, Hu and others forged state organ documents in order to obtain illegal benefits, and the circumstances were serious, so they prosecuted Yu and 58 others on suspicion of forging state organ documents.
A few days ago, after trial, the court sentenced the defendant Yu to three years in prison and a fine of 30,000 yuan for the crime of forging documents of state organs; Defendants Wang, Chen, and Hu were sentenced to one year and six months imprisonment, suspended for one year and six months to two years and eleven months, with a suspended sentence of three years, and each fined concurrently; Corresponding judgments were also made against the rest of the persons involved in the case.
In the course of handling the case, the prosecutor in charge found that 7 of the relevant personnel of an automobile service company illegally handled 32 violation records through the online platform. In this regard, the Baoshan District Procuratorate issued a procuratorial recommendation to the company, suggesting that it implement the real-name registration system for the use of vehicles, strengthen supervision and management, and regularly carry out safety training and legal education. At present, the company has adjusted the company's internal management in accordance with the procuratorial recommendations.
In addition, the Baoshan District Procuratorate also issued procuratorial recommendations to relevant departments, suggesting that administrative penalties be given to those involved in the case such as "sellers" who deduct points for others and "buyers" who actually violate regulations, strengthen the cleanup and banning of illegal intermediaries and platforms, and improve the awareness of the rule of law among motor vehicle drivers.
