The reporter learned from Anfu County, Ji'an City, Jiangxi Province, that in order to severely crack down on the crime of telecommunications network fraud and rectify the cross-border illegal and criminal activities between China and Myanmar, after the previous stage of urging, some people illegally stranded in northern Myanmar in Anfu County have returned to their places of household registration, and there are still 17 stubborn people of Anfu nationality stranded in northern Myanmar who have not returned to their places of household registration as required.
In accordance with the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, the Law of the People's Republic of China on exit-entry Administration, the Law of the People's Republic of China on Public Security Administration Penalties, and other relevant laws and regulations, 17 recalcitrant personnel of Anfu nationality who are illegally stranded in northern Myanmar are given punitive measures such as canceling payment business and restricting employment in the party and joining the army, and the specific notice is as follows:
1. Suspension or cancellation of communications and payment business. Lawfully suspend all bank cards, mobile phone cards, and other businesses under the names of stubborn persons in northern Myanmar, and must not open new bank cards and telephone cards (bank cards include personal bank cards, non-bank payment accounts, weChat, Alipay and other third-party payment platform accounts; telephone cards include telecommunications, mobile, and Unicom mobile phone cards, virtual operators' telephone cards, and Internet of Things cards); suspects involved in telecommunications network fraud, gambling, and illegal crimes such as crossing the national (border) border in northern Myanmar, and their immediate family members and friends have capital transactions with them; The bank accounts and online banks of their immediate family members and friends are frozen and countered, and the relevant business qualifications are cancelled.
II. Restrictions on joining the Party, joining the army, and employment. In principle, when they themselves and their immediate family members who are stranded in northern Myanmar, they will not pass in principle when they inquire about joining the party, joining the army, recruiting civil servants, recruiting public institution staff, and employment.
3. Suspension of subsidies. The recalcitrant persons stranded in northern Myanmar have not returned within the prescribed time, suspended all policy-based preferential subsidy (assistance) funds for themselves and their immediate family members, and strictly examined and approved the major illness insurance policy.
4. Public persuasion to return. All stubborn people stranded in northern Myanmar are publicly exposed, and notices of personnel in nests in northern Myanmar are posted in urban and rural areas, downtown areas, and schools, and broadcast uninterruptedly through social public service video advertisements, rural voice broadcasts, and other methods.
Fifth, strike hard and strictly pursue responsibility. All illegal and criminal acts committed by personnel of dens in northern Myanmar and their immediate family members shall be strictly and promptly and re-investigated; no unit or organization or individual may provide hidden places, property, or means of transportation for persons who have violated the law outside Myanmar, provide them with information, give false testimony, shield or provide other convenient conditions to help them escape, and will be investigated for legal responsibility in accordance with law. Where village (community) cadres and other public employees do not take the initiative to truthfully report that their immediate family members are engaged in new types of illegal and criminal activities in telecommunications networks or living in northern Myanmar, once verified, they will be investigated by the Discipline Inspection Commission Supervision Commission and other relevant functional departments for responsibility.
6. Rewards for whistleblowing. Rewards will be given to those who report illegally stranded persons in northern Myanmar and those who have participated in telecommunications network fraud, gambling, illegal crossing of national (border) borders, and other illegal crimes in northern Myanmar.
The circular also emphasizes that by December 25, 2021, recalcitrant persons who are illegally stranded in northern Myanmar can return to their place of household registration and can be lightly or exempted from punishment. Anyone who entrusts another person to surrender on his behalf or who surrenders himself or herself by letter, telephone, or other means, and then arrives at the case in a timely manner, or surrenders under the persuasion or escort of relatives or friends, or where relatives or friends take the initiative to report the case and send the suspect to surrender, are deemed to have voluntarily surrendered. Voluntary surrender may be lawfully employed as appropriate to non-custodial compulsory measures. Where they truthfully confess their illegal or criminal conduct, they may be given a mitigated or mitigated punishment in accordance with law; where the circumstances of the crime are relatively minor, punishment may be waived in accordance with law. Those who voluntarily surrender when returning to China must strictly abide by the national epidemic prevention and control regulations, declare their return to China in accordance with laws and regulations, and must not smuggle back to China. If the above-mentioned persons still insist on going their own way and refuse to return to China, the public security organs will lawfully employ case filing and investigation, online pursuit and escape, and related punitive measures.
