The Maonan Court strongly promotes enforcement! The wages of 18 migrant workers were fully implemented

On the morning of December 30, the Maonan District People's Court (hereinafter referred to as the "Maonan Court") held a ceremony to distribute the payment of funds for the enforcement of the case, and paid the wages to 18 migrant workers. The migrant workers who received the wages smiled and expressed their gratitude to the executives.

Wei and 18 other migrant workers were formerly employees of a foot shop. The owner of the foot shop, Lin Mou, owed Wei And others a total of more than 60,000 yuan in wages, and repeatedly urged him to pay it. Wei and others sued Lin to the Maonan Court, which ordered Lin to pay more than 60,000 yuan in wages to Wei and 18 others within a time limit. After the judgment took effect, Lin did not pay the arrears of wages as scheduled, and Wei and others applied to the Maonan Court for compulsory enforcement in October 2021.

After the case entered the enforcement procedure, the Maonan court attached great importance to the enforcement of the batch of cases. While promptly issuing legal documents such as enforcement notices and property report orders to Lin, the enforcement personnel urgently checked and controlled Lin's property through the network inspection and control system. However, after the "four investigations" and other procedures, the enforcement personnel did not find that Lin mou had property available for execution. However, Lin did not report his property according to law, and repeatedly refused to receive calls from enforcement personnel to evade enforcement.

In order to help these migrant workers recover their wages, the enforcement personnel took punitive measures against Lin in accordance with the law, such as restricting high consumption and being included in the list of untrustworthy persons subject to execution, and summoned Lin to appear in court for questioning.

After Lin learned that the Maonan court had taken measures against him, he knew that hiding was not the way to go, so he came to the court on December 6, 2021 as required. In response to Lin's evasion of enforcement and failure to declare assets in accordance with law, the enforcement personnel intend to take him into judicial detention. Intimidated by the pressure of execution, Lin paid 17,000 yuan on the spot, and his wife Ding provided an execution guarantee, promising to pay the remaining amount before December 20, 2021. In view of the fact that Lin's attitude has undergone a major change and part of the payment has been fulfilled, the enforcement personnel decided to suspend his detention.

However, after the expiration of the performance period of the promise, Lin and his guarantor Ding did not perform. On December 24, the enforcement officers found Ding mou and informed him that if he delayed performance by means of guarantees, he would also face the consequences of judicial detention. Ding quickly admitted his mistake, saying that he was already actively raising funds, and issued a letter of guarantee on the spot to ensure that the remaining funds would be fulfilled in one lump sum the next day. Under the strong deterrent of enforcement, Lin did remit the remaining case money of more than 50,000 yuan to the court's special account the next day.

After the court received all the case money, it immediately opened a green channel for the batch of migrant workers and stepped up the procedures for disbursement. "I didn't expect to be able to recover my salary so quickly, it's really a court that does practical things for the masses!" At the centralized distribution ceremony of the case funds, Wei Mou and others happily signed the payment procedures and praised the Maonan court.

According to the relevant person in charge of the Maonan Court, since the launch of the winter special action to eradicate wage arrears, the court has promoted the implementation work with a resolute attitude and effectively protected the legitimate rights and interests of migrant workers. In the next step, the Maonan court will further strengthen enforcement, improve the effectiveness of enforcement, strengthen the use of disciplinary measures, severely crack down on "refusal to enforce" behavior, and strive to achieve the benefit of winning lawsuits for relevant workers.
