The holiday lasts for 3 days
If you work overtime during the New Year's Day holiday, will you calculate the overtime pay?
Among the 3 days of New Year's Day holiday, only January 1 is a legal holiday. Therefore, if you work overtime for all three days, the calculation of overtime pay will be different.
1. January 1, 2024 is a statutory holiday, and if the employer arranges for the employee to work overtime, the employer shall pay the overtime wage at a rate not less than 300% of the employee's daily or hourly wage, and shall not replace it with compensatory leave.
2. If the employer arranges overtime work on December 30 and 31, 2023, the employer shall first arrange for the employee to take compensatory leave, which shall not be less than the overtime time, and if the compensatory time cannot be arranged, the overtime wage shall be paid at a rate not less than 200% of the base amount of the employee's daily or hourly overtime wage.
Therefore, on New Year's Day, overtime will be paid 3 times the salary!
