At the beginning of October 2022, the defendant Yu Moumou told Xie Moumou that he could buy a C1 driver's license without taking the test and spending money.
On the grounds of applying for a driver's license, Yu Moumou asked Xie Moumou to pay in cash and transfer 7,500 yuan on WeChat. After a period of time, Xie Moumou asked about the progress of the driver's license application, and Yu Moumou falsely claimed that it had been completed, and delayed it on the grounds that the license was still being issued. At the urging of Xie XX, Yu XX admitted the fact that he had deceived Xie XX. After the case was discovered, the defendant and his family returned all 7,500 yuan to Xie XX.
Heard by the courts
After trial, the Fengxin County People's Court found that defendant Yu XX's conduct constituted the crime of fraud, and the amount was relatively large. In view of the fact that defendant Yu XX had sentencing circumstances such as confession, positive restitution, and admission of guilt and acceptance of punishment, the court sentenced defendant Yu XX to six months' short-term detention, suspended for one year, and fined 1,500 yuan.

Article 266:[Crime of Fraud]Whoever defrauds public or private property, and the amount is relatively large, is to be sentenced to up to three years imprisonment, short-term detention or controlled release, and/or a fine; where the amount is huge or there are other serious circumstances, a sentence of between 3 and 10 years imprisonment and a concurrent fine is to be given; where the amount is especially huge or there are other especially serious circumstances, a sentence of 10 or more years imprisonment or indefinite imprisonment is to be given, and a concurrent fine or confiscation of property. Where this Law provides otherwise, follow those provisions.
