Recently, the Market Supervision Bureau of Haidian District, Beijing, together with the police, cracked down on an act of throwing cockroaches in a restaurant to demand high compensation.

In April this year, the "consumer" Su went to a grilled fish restaurant to dine alone, saying that he had eaten cockroaches (cooked) and asked the restaurant for 1,000 yuan in compensation. After negotiation, the restaurant compensated the customer 500 yuan and gave him a free order, and after obtaining the compensation, Su deleted the store manager's WeChat. After learning about the situation, law enforcement officers found that Su had released cockroaches to many restaurants in the city in the same way in a short period of time to claim compensation. According to another grilled fish restaurant, after Su ate cockroaches in the store and asked for compensation, the store manager retrieved the monitoring and found that Su was suspected of placing cockroaches when flipping through the menu, and as soon as he heard that the store manager was going to call the police, Su immediately paid and left.

In response to Su's suspected malicious claims, after many consultations, the Haidian District Market Supervision Bureau transferred the clues to the Haidian police, and Su confessed to his extortion after being caught by the public security department. According to Su's confession, the cockroaches that were "eaten" were actually collected at home and cooked by himself, brought by him to the restaurant for delivery, and then asked the merchant for compensation. At present, the police have verified a number of extortion facts carried out by Su, and have taken criminal coercive measures against Su in accordance with the law.
This is the fourth case of malicious professional claims arrested by the Haidian District Market Supervision Bureau through execution. Since July last year, the District Market Supervision Bureau has successfully cracked down on three cases of malicious claims and extortion through big data analysis and execution, and arrested the staff and Sun Moumou who added hair and bugs to the takeaway, as well as Yao Moumou who added bread worms to the restaurant meal.

With the increasing prosperity of the consumer market, the importance of consumer rights and interests protection is becoming more and more prominent, however, rights protection is to safeguard the legitimate rights and interests of consumers, not a tool for "touching porcelain" claims, and the legitimate rights and interests of buyers and sellers should be protected by law.
The Regulations on the Implementation of the Law of the People's Republic of China on the Protection of Consumer Rights and Interests (hereinafter referred to as the "Regulations") promulgated by the State Council on March 15, 2024 will come into force on July 1, 2024. Article 49 of the "Regulations" clearly requires that if the operator is defrauded of compensation or extorted from the operator by means of entrainment, package dropping, counterfeiting, tampering with the production date of the goods, fabricating facts, etc., the provisions of the first paragraph of Article 55 of the Law on the Protection of Consumer Rights and Interests shall not apply, and shall be handled in accordance with the "Public Security Administration Punishment Law of the People's Republic of China" and other relevant laws and regulations; where a crime is constituted, criminal responsibility is pursued in accordance with law. On April 17, the Beijing Municipal Government issued the "2024 Key Points for Comprehensively Optimizing the Business Environment in Beijing", which also clearly stated that it is necessary to strengthen the governance of malicious professional claims.
For a long time, the Haidian District Market Supervision Bureau has always taken the strengthening of the construction of the industry style as an important path to unswervingly promote the comprehensive and strict governance of the party, and the consolidation of the construction of the industry style as a strong guarantee for improving the level of market supervision services, actively optimizing the business environment in the jurisdiction, and establishing and improving three mechanisms: first, optimize the big data analysis mechanism, regularly sort out and analyze the complaint and reporting platform, and focus on the problem of an abnormally large number of complaints in the short term; The second is to build a collaborative governance mechanism, smooth information reporting channels with platform enterprises, timely discover malicious claims and extortion clues, and promote the healthy and orderly development of the online market ecology in the jurisdiction; The third is to smooth the channels for information sharing, accurately connect with the demands of enterprises, guide enterprises to operate in compliance with the law, and actively enhance the awareness of rights protection to achieve information sharing. Through the three mechanisms, we actively hold regular meetings with the Haidian District People's Procuratorate and public security organs to form a joint force to severely crack down on bad behaviors suspected of extortion.
Handling complaints immediately is an effective way to do practical things for the masses and solve problems, rather than a channel for illegal profit-making, and a healthy and orderly market economic order and consumption environment need to be jointly maintained. The Haidian District Market Supervision Bureau will continue to achieve the "big theme" of optimizing the business environment through the "small incision" of professional claims management, promote the solution of deep-seated regulatory problems, and continue to contribute to the construction of high-quality Haidian market supervision.
At the same time, it also reminds the majority of food business enterprises to earnestly fulfill their main responsibilities, strengthen food safety management, strictly regulate business behavior, and report to the police in a timely manner if suspected malicious claims are found in the course of operation.
