On August 5, The Paper learned from Tesla that recently, the reputation infringement case between Tesla and Xi'an Li (one of the core members of the Shanghai Auto Show incident) ushered in the second-instance judgment, and the amount of compensation that Li should compensate Tesla was adjusted from 2,000 yuan in the first instance to 70,000 yuan. Li's grounds for appeal were not established, and the court did not accept Li's appeal claim. At the same time, the judicial appraisal agency entrusted by the court conducted an appraisal of the vehicle involved in the case, and the appraisal opinion was: Tesla's vehicle braking system is normal, effective and trouble-free, and meets the relevant technical standards.
According to previous media reports, in November 2023, in the case of Tesla v. Xi'an Li for the infringement of reputation rights in the "Shanghai Auto Show Incident", the court made a first-instance judgment, finding that Ms. Xi'an Li's reputation infringement liability was established, and she must publicly apologize to Tesla and compensate for economic losses and rights protection costs of 2,000 yuan, and bear the vehicle appraisal fee. Xi'an Li was involved in a traffic accident while driving a Tesla in March 2021 and participated in the subsequent "Shanghai Auto Show Incident".
Previously, Henan Zhang, who stood on the roof of the car at the Shanghai Auto Show, has been found to have violated Tesla's right to reputation, and the self-media Feng, Big Eye Brother and others have also been awarded compensation by the court for spreading rumors and smearing Tesla.
Zhang is a Tesla owner and one of the parties to the "Shanghai Auto Show Incident" on April 19, 2021.
On May 30 this year, the Shanghai Qingpu District People's Court made a first-instance judgment in this case: Zhang publicly issued an apology statement and compensated Tesla (Shanghai) Co., Ltd. for various losses totaling 172275 yuan.
Also on May 30, car blogger Feng Shiming sued Tesla for a dispute over the right to reputation, and the court rejected all his claims; Tesla sued Feng Shiming for a dispute over the right to reputation, and the court ruled that Feng Shiming publicly issued an apology statement and compensated Tesla 250,000 yuan.
According to data from the Passenger Association and Tesla, Tesla's Shanghai Gigafactory delivered 74,100 vehicles in July, a year-on-year increase of 15%; Domestic sales reached 46,000 units, up 47% year-on-year.
In recent months, Tesla's domestic sales have shown a rebound trend. According to the data of the passenger association, Tesla's domestic sales in June were 59,000 units, an increase of 7% month-on-month. Previously, Tesla's domestic sales in May reached 55,000 units, an increase of 77% month-on-month. In the second quarter of this year, Tesla's total domestic sales increased by 10.2% quarter-on-quarter.
