Article 9 Rights and Obligations of the Parties
1. Rights and obligations of the shipper
1. The shipper's right: the carrier is required to transport the goods to the destination at the time and place specified in the contract. After the consignment of the goods, the shipper has the right to request the carrier to change the content of the contract or cancel the contract if it needs to change the place of arrival or the consignee, or cancel the consignment. provided, however, that the Carrier must be notified before the Cargo arrives at the place of destination and shall be paid to the Carrier in accordance with the relevant regulations.
2. Shipper's Obligation: Deliver freight and miscellaneous charges to the Carrier as agreed. Otherwise, the Carrier reserves the right to stop the carriage and demand liquidated damages. The shipper shall pack the consignment goods in accordance with the prescribed standards, comply with the provisions on the transportation of dangerous goods, and deliver the consignment goods in accordance with the time and quantity specified in the contract.
II. Rights and Obligations of the Carrier
1. The carrier's rights: to charge the shipper and the consignee for transportation and miscellaneous charges. If the consignee fails to pay or fails to pay the prescribed miscellaneous charges on time, the carrier has the right to withhold its goods. If the consignee cannot be found or the consignee refuses to take delivery of the goods, the carrier shall contact the shipper in a timely manner, be responsible for the custody within the specified time limit and have the right to charge the storage fee, and the carrier shall have the right to deal with the goods that cannot be delivered beyond the specified time limit.
2. The carrier's obligation: to deliver the goods to the designated place within the time limit specified in the contract, and to notify the consignee of the arrival of the goods on time. Be responsible for the safety of the consignment of goods, ensure that there is no shortage of goods, no damage, no man-made deterioration, if there are any of the above problems, should bear the obligation of compensation. After the arrival of the goods, we are responsible for the storage of the goods within the prescribed period.
3. The rights and obligations of the consignee
1. The right of the consignee: After the goods are transported to the designated place, they have the right to receive the goods with certificates. If necessary, the consignee has the right to request to change the arrival or change the consignee to the station where the goods are located, and sign a change agreement.
2. The consignee's obligation: after receiving the notice of delivery, pick up the goods on time and pay the fees payable. When the specified delivery is exceeded, the storage fee shall be paid to the carrier.
Article 10 Liability for breach of contract
1. Shipper's Responsibilities
1. If the consignment is not provided at the time and required according to the contract, the shipper shall reimburse the carrier for liquidated damages at the rate of ____% of its value.
2. The shipper shall be liable for compensation due to accidents such as spreader breakage, cargo damage, crane overturning, explosion, and rotting candles caused by entrainment or concealment of dangerous goods in general cargo, misreporting of the weight of bulky goods, etc.
3. The shipper shall be liable for compensation if other goods, means of transport, machinery and equipment are polluted, corroded, damaged, or injured due to defects in the packaging of the goods.
4. If the goods are found to be damaged or missing when the goods are unloaded on the shipper's special line or at the port or station public line or special line, the shipper shall compensate the consignee for the loss if the vehicle is sealed intact or there is no abnormality.
5. If the consignee is unable to unload the cargo due to the failure to attach the specification quality certificate or laboratory report with the tanker, the shipper shall reimburse the carrier for the deposit fees and liquidated damages for unloading the truck.
II. Carrier's Responsibilities
1. If the vehicle is not allocated and shipped according to the time and requirements specified in the contract, the carrier shall pay Party A liquidated damages of ____ yuan.
2. If the carrier transports the goods to the wrong place or the receiver, it shall be transported to the place of arrival or the receiver specified in the contract free of charge. If the goods are overdue, the carrier shall reimburse the liquidated damages for late delivery.
3. In the event of loss, shortage, deterioration, pollution or damage to the goods during transportation, the carrier shall compensate the shipper according to the actual loss of the goods (including packaging costs, transportation and miscellaneous expenses).
4. In the event of loss, shortage, deterioration, pollution or damage to the goods transported by intermodal transport, the carrier shall be liable for compensation, and the carrier at the end of the terminal stage shall be liable for compensation from other carriers.
5. The Carrier shall not be liable for breach of contract if the goods are lost, deficient, deteriorated, polluted or damaged due to the following reasons:
(1) Force majeure;
(2) the natural properties of the goods themselves;
(3) reasonable wear and tear of the goods;
(4) The fault of the shipper or the consignee.
The original of this contract shall be in duplicate, and both parties shall hold one copy each; A copy of the contract shall be made and one copy shall be retained by each of the sending units.
