Criminal Law of the People's Republic of China
Article 115 Whoever causes serious injury or death to a person or causes major losses to public or private property by setting fire, breaching water, exploding, or disseminating poisonous, radioactive, or infectious disease pathogens, or by other dangerous means, shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment, or death. Whoever commits the crime in the preceding paragraph by negligence is to be sentenced to fixed-term imprisonment of not less than three years but not more than seven years; where the circumstances are more minor, a sentence of up to three years imprisonment or short-term detention is to be given.
Forest Fire Prevention Regulations
Article 48 In violation of the provisions of these Regulations, the management units or individuals of forests, woods, and forest lands shall fail to perform their responsibilities for forest fire prevention, and the competent departments of forestry of the local people's governments at or above the county level shall order them to make corrections, and impose a fine of not less than 500 yuan but not more than 5,000 yuan on individuals, and not more than 10,000 yuan but not more than 50,000 yuan on units.
Article 49 In violation of the provisions of these Regulations, if the relevant units or individuals in the forest fire prevention area refuse to accept the forest fire prevention inspection or fail to eliminate the fire hazards within the time limit after receiving the notice of rectification of forest fire hazards, the competent department of forestry of the local people's government at or above the county level shall order them to make corrections, give them a warning, and impose a fine of not less than 200 yuan but not more than 2,000 yuan on individuals, and not more than 5,000 yuan but not more than 10,000 yuan on units.
Article 50 Whoever, in violation of the provisions of these Regulations, uses fire in the wild in the forest fire prevention zone without approval during the forest fire prevention period, shall be ordered by the competent department of forestry of the local people's government at or above the county level to stop the illegal acts, give a warning, and impose a fine of not less than 200 yuan but not more than 3,000 yuan on individuals, and not less than 10,000 yuan but not more than 50,000 yuan on units.
Article 52 Anyone who violates the provisions of these Regulations and commits any of the following acts shall be ordered by the competent department of forestry of the local people's government at or above the county level to make corrections, give a warning, and impose a fine of not less than 200 yuan but not more than 2,000 yuan on individuals, and not more than 2,000 yuan but not more than 5,000 yuan on units:
(A) during the forest fire prevention period, forests, woods, woodlands business units do not set up forest fire prevention warning signs;
(B) during the forest fire prevention period, into the forest fire prevention area of motor vehicles without forest fire prevention devices;
(3) During the period of high forest fire risk, entering the forest high fire risk area without approval.
Article 53 Whoever violates the provisions of these Regulations and causes a forest fire and constitutes a crime shall be investigated for criminal responsibility according to law; If it does not constitute a crime, in addition to pursuing legal responsibility in accordance with the provisions of Articles 48, 49, 50, 51 and 52 of these Regulations, the competent department of forestry of the local people's government at or above the county level may order the responsible person to replant trees.
