After listening to the opinions of various parties, the District Market Supervision Bureau, the Consumer Protection Committee, the Catering Association and other departments jointly researched and formulated a model text "Shanghai Jinshan District Banquet Service Contract", which greatly reduced the risk of disputes caused by information asymmetry or poor communication.
On September 6, the service contract promotion meeting was held, and 35 banquet catering enterprises in Jinshan gathered together to learn and promote together.
"Party A and Party B agree that Party A may unconditionally request to unilaterally terminate this contract within a few days from the date of Party B's receipt of Party A's advance payment. This period is a cooling-off period, and it is also an open date that can be negotiated by both parties. Tang Yini, District Market Supervision Bureau, said.
The reporter learned that when formulating the banquet service contract, the three highlights of changing the traditional advance deposit to advance payment, setting a certain period of cooling-off period, and stepping the liability for breach of contract can not only protect the rights and interests of both parties, but also reduce the risk of disputes.
Zhu Meixin, Secretary-General of the District Consumer Protection Committee, said: "This contract provides a more fair and transparent trading environment for consumers and operators, reduces all kinds of consumer disputes caused by unclear contract terms, and greatly reduces the pressure on the court to litigate in this regard, so as to better promote the management of litigation sources." ”
The contract also sets out key terms such as service content, standards, prices and liability for breach of contract, which not only ensures the quality of service, but also allows consumers to have a clear understanding of the expected results before enjoying the service.
