According to the Jiangsu public news channel "News Space Station" reported: On January 1 this year, the "Family Education Promotion Law" was officially implemented, which is the first time that China has carried out special legislation on family education, and recently, courts in Huai'an, Nanjing and other places in Jiangsu have successively issued "Family Education Orders" to urge incompetent parents to effectively assume the main responsibility for family education.
On January 1, 2022, the first day of the official implementation of the Family Education Promotion Law, the Xuyi County People's Court of Jiangsu Province issued the first family education order in the province.
After investigation, the father of the under-adult prisoner junjun raised the child alone, and because he was busy with his livelihood and neglected discipline, the child dropped out of school and returned home at the age of 15. In November 2020, the military, led and seduced by idle members of society, was sentenced to five years in prison for participating in the crime of rape. The court held that the father of the military army, as a guardian, did not effectively perform his guardianship duties and neglected family education, which to a certain extent led the child to embark on the road of breaking the law and committing crimes. On the day of the family education order, the Xuyi County People's Court conducted family education counseling for the father of the military army on the United County Women's Federation, including how to re-establish effective family communication with the child who is serving a sentence, how to help the child re-understand himself and correct his mistakes as soon as possible, and how to guide the child to make career planning in the later stage, etc., to supervise, guide and help him become a competent father.
On January 10, 2022, the Nanjing Xuanwu District People's Court also issued a family education order against a father who refused to allow his mother to visit his 2-year-old child.
Shao Xiaobo, president of the Suojin Village Court of the Xuanwu District People's Court of Nanjing City, told reporters that during the trial of family cases, it was found that in the divorce proceedings of parents, the robbery and hiding of children occurred from time to time. The case-handling personnel also passed the "Family Education Order" to advocate that even if the parents are divorced, they should not affect the subsequent education of their children because of personal emotional reasons.
The court held that even if the husband and wife divorce, both parties must jointly fulfill their educational obligations to the child and ensure the healthy growth of the child. In this case, one party raised a child, and he had to fulfill the obligation of cooperation with the other party to visit the child, which was suitable for issuing an education order, which also implemented the emphasis of the Family Education Promotion Law, parents including guardians, establishing the family as the first classroom, parents being the first teacher's sense of responsibility, and fulfilling the obligation of joint education for children.
