Wuhan issues first Family Education Order

(Reporter Tang Weiwei, correspondent Lei Cen cen, Yang Lan) On February 11, at the Qingshan District People's Court in Wuhan City, the judge issued a "Family Education Order" to Yang Mou, the father of two children. This is the first "Family Education Order" issued by Wuhan City.

On January 1 this year, the Family Education Promotion Law was officially implemented, and the issue of the education of minor children rose from "family affairs" in the traditional sense to "state affairs" with laws to rely on. Article 34 of the Family Education Promotion Law clearly stipulates: "When hearing divorce cases, the people's courts shall provide family education guidance to both husband and wife with minor children".

On December 27, 2021, Liu sued the Qingshan District People's Court of Wuhan City because of his disagreement with her husband Yang. During the trial, Hu Yang, the judge in charge of the case, found from Liu Mou's repeated emphasis that "he scolded the child at every turn" and "the children also said that they didn't like him and wanted to follow me", that the case not only involved the marriage problems of two adults, but also reflected that the healthy growth of the two minor children needed urgent care. Combined with the specific facts of the case, Hu Yang issued a "Family Education Order" in response to Yang's erroneous education methods, ruling that Yang paid more attention to the physical, psychological and emotional needs of children born in wedlock, and used scientific family education methods.

On the same day, the court also invited Wei Zhuo, a legislative expert of the "Hubei Provincial Family Education Promotion Regulations" and vice president of the Hubei Marriage and Family Research Association, to have a long talk with Yang Mou. Wei Zhuo from the legislative spirit of the Family Education Promotion Law to the psychological tips of communicating with children to guide Yang Mou, reminding him to pay attention to the child's inner world and fully respect the child's ideas. After the end of the family education guidance, Hu Yang, a psychologist counseling expert, talked to the two children separately. Hu Yang told the children that the Qingshan District People's Court would return to visit them regularly, continue to provide them with family education guidance and help, and leave their contact information to them.
