The "Law of the People's Republic of China on the Prevention and Control of Air Pollution" stipulates that in accordance with Article 119 of the "Law of the People's Republic of China on the Prevention and Control of Air Pollution", the supervision and management department designated by the local people's government at or above the county level shall order corrections and may impose a fine of not less than 500 yuan but not more than 2,000 yuan. 2. "Public Security Administration Punishment Law of the People's Republic of China" (1) Whoever intentionally burns the crop straw of others, causing property losses to others, shall be detained for not less than 5 days but not more than 10 days for "intentional damage to property" in accordance with the provisions of Article 49 of the "Public Security Administration Punishment Law of the People's Republic of China", and may be concurrently fined up to 500 yuan; where the circumstances are more serious, they are to be detained for between 10 and 15 days, and may be concurrently fined up to 1,000 RMB. (2) Refusal to carry out decisions or orders issued by the people's government in accordance with law under the circumstances of a state of emergency; Those who do not heed dissuasion, deliberately burn crop straw, and obstruct the functionaries of state organs from performing their duties in accordance with law. Those who commit any of the above acts shall be given a warning or a fine of up to 200 yuan in accordance with article 50 of the "Public Security Administration Punishment Law of the People's Republic of China"; where the circumstances are serious, they are to be detained for between 5 and 10 days, and may be concurrently fined up to 500 RMB. (3) In the work of banning straw burning, disobey management, beat, intentionally injure, or openly insult town and village cadres, in accordance with the provisions of Article 42 and Article 43 of the Law of the People's Republic of China on Public Security Administration Punishments, they shall be detained for less than 5 days or fined less than 500 yuan, and if the circumstances are serious, they shall be detained for not less than 5 days but not more than 10 days, and shall be fined. 3. The Criminal Law of the People's Republic of China (1) Where intentional burning of crop straw causes a fire, causing serious injury or death, or causing major losses to public or private property, the crime of arson shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or the death penalty in accordance with article 115 of the Criminal Law of the People's Republic of China; Whoever commits the crime in the preceding paragraph by negligence is to be sentenced to fixed-term imprisonment of not less than three years but not more than seven years; where the circumstances are more minor, a sentence of up to three years imprisonment or short-term detention is to be given. (2) Whoever obstructs the lawful performance of duties by means of violence or threats in the work of banning straw burning shall be sentenced to fixed-term imprisonment of not more than three years, short-term detention, controlled release or a fine for the crime of obstructing public affairs in accordance with the provisions of Article 277 of the Criminal Law of the People's Republic of China.
