"There are a total of '4+10' statutory areas in procuratorial public interest litigation, follow this map to find the story of procuratorial performance!" Early in the morning of May 15, a comic-style "Ancient Map of Public Interest Litigation" was unveiled at Exit 4 of Tongjing Road Station of Suzhou Rail Transit Line 2 in Jiangsu Province. Pedestrians stopped one after another, took out their mobile phones to scan the code, and wanted to see the story behind the map.

"Public Interest Litigation Ancient Style Map" is a subway poster launched by the Suzhou Procuratorate in the sixth quarter. In order to fully introduce the public interest litigation procuratorial function, each story screen on the poster is equipped with a QR code for relevant news reports.

"Public interest litigation continues to grow outward and take root downward, and is close to the life of firewood, rice, oil and salt." On the WeChat public account of the Suzhou Municipal Procuratorate in Jiangsu Province, the editor interpreted the poster with beautiful poetry lines. The "beginning and end" in the poem is the melody of the performance of the public interest litigation prosecution of the Suzhou procuratorate.

From: Clues come from the masses

Clues are the "source of living water" for procuratorial public interest litigation. As early as 2008, when the procuratorial public interest litigation system had not yet sprouted, the Suzhou procuratorate received a visit from a citizen who had committed harm to the public interest. At that time, I.M. Pei's image of a rockery designed for the Suzhou Museum was used in a magazine advertisement by a company, and the citizen took the initiative to report the supervision clues to the former Pingjiang District Procuratorate of Suzhou City after seeing it. In this regard, the procuratorate supported the Suzhou Museum in filing a civil lawsuit, which was the first exploration of the Suzhou procuratorate to carry out public interest litigation based on reports from the masses.

In the Spring Festival of 2011, a house in Gusu District, Suzhou City, was seriously squeezed by the city wall of Changmen, and even made a loud noise. The clue he reported to the prosecutor opened the prelude to the Gusu District Procuratorate's special action to protect the public welfare of the "Procuratorial City Wall". After four years of procuratorial investigation and two years of legislative argumentation, in March 2018, the Regulations on the Protection of the Ancient City Wall of Suzhou and the Regulations on the Protection of the National Historical and Cultural City of Suzhou were officially implemented.

In August 2018, the Gusu District Procuratorate and Suzhou Daily jointly launched the "Public Welfare Guardian Alliance" column, which has become a media link for the procuratorate to collect clues from the public interest litigation.

In 2021, the Suzhou Municipal Procuratorate issued the Measures for Rewarding Reports of Public Interest Litigation Cases. Xiao Luo, a fourth-year student at Changshu Institute of Technology, reported that there were clues that there were cracks in the tombstone of the "Two Righteous Warriors" in Changshu, which contributed to the restoration of cultural relics, so he was rewarded with 500 yuan.

Enthusiastic public welfare people like Xiao Luo have joined the volunteer team of "Benefiting the Public" in recent years. In February 2022, the "Benefiting the Public" procuratorial cloud platform developed and constructed by the Supreme People's Procuratorate was piloted in Jiangsu. Today, the Suzhou procuratorate has a total of 1,580 volunteers.

Commitment: Focus on new problems and new forms of business to perform duties accurately

If there are clues, can the procuratorial organs catch them and handle them well? It is very important for public interest litigation procurators to perform their duties accurately.

Geng Guanghang, assistant prosecutor of the Suzhou Industrial Park Procuratorate, analyzed the 276 cases of telecommunications fraud and aiding information network criminal activities handled by the procuratorate since 2022 and found that most of the people involved were young, low-educated, and low-income people, and a quarter of them were deceived and involved in crimes because they were exposed to illegal online recruitment information. Subsequently, the WeChat public account of "Employment Bar S Zhou" was dug up for publishing job information containing words such as "listening to lectures" and "filling the field", and the unit is unknown and the salary is abnormally high. The procuratorate formulated and issued procuratorial recommendations to the human resources and social security departments, took the lead in organizing consultations between human resources and social security, public security, internet information and other units, and went to industry associations to carry out compliance counseling, promoting the investigation of 102 institutions, the closure of 20 illegal intermediaries, and the issuance of 5 administrative punishments.

In February 2023, the Kunshan Municipal Procuratorate found that food delivery riders in the jurisdiction generally did not sign labor contracts and were unwilling to pay social insurance, so they would be in a vulnerable position in the event of a work-related injury and other disputes. After the clues of the relevant problems were designated by the Supreme People's Procuratorate, the Jiangsu Provincial Procuratorate led the Suzhou and Kunshan procuratorates to set up a special case team, which finally prompted the relevant enterprises to rectify and cancel the registration of individual industrial and commercial households for the food delivery riders.

Subsequently, the Kunshan Municipal Procuratorate fed back the deep-seated problems exposed by the case and a series of suggestions to the relevant departments. In May 2023, the Ministry of Human Resources and Social Security began to explore the pilot of occupational injury insurance for workers in the new business format, focusing on the group of food delivery riders, and promoted relevant enterprises to pay occupational injury insurance for riders. Occupational injury insurance has been fully implemented in Suzhou, and a total of 3,368 occupational injuries have been confirmed so far, benefiting nearly 2,000 employees in the new industry.

Big data creates more possibilities for public interest litigation

Once, the public interest litigation prosecutor brought a trekking pole to the scene and inserted it into the ground, and the depth of the soil involved in the case was immediately revealed. At one time, sneakers were the standard for public interest litigation prosecutors, and "there is no kind of supervision that does not need to walk on the road to the scene." ”

Technological innovation has transformed the procuratorial work mechanism for public interest litigation. Today, in the Suzhou procuratorate, public interest litigation rapid detection roving workstations, satellite remote sensing technology, unmanned aerial vehicles, unmanned boats, underwater robots, etc., have all become the "eyes of science and technology" for public interest litigation prosecutors.

In handling a series of public interest litigation cases on the Grand Canal and Taipu River, the Suzhou procuratorate found that there were outstanding problems in the approval, transportation, and consumption of engineering residue, and then confirmed that the illegal dumping and disposal of engineering residue had a significant negative impact on the ecological environment, navigation safety, flood safety, and urban style through the deployment of special supervision, research, and big data analysis, so it took the initiative to seek data support from urban management, transportation, maritime affairs, public security and other departments. Jointly develop a big data legal supervision model for ship cross-regional dumping of engineering residue. Up to now, the model has found more than 200 clues on illegal dumping of production safety, and transferred 2 cases of suspected criminal clues to the public security organs and 13 people.

Together: Gather together and let the guardian "hand in hand"

"Whether it is to uproot the 'data chimney' or solve practical problems, the facts are confirming a truth - public interest litigation is not a one-way line for the lone brave, and only a win-win, multi-win, and win-win benign supervision can continue to empower social governance." Yan Zhongliang, director of the public interest litigation prosecution department of the Jiangsu Provincial Procuratorate, said, "The road of public interest litigation should be wider and wider. ”

From escorting the development of rural characteristic industries such as hairy crabs in Yangcheng Lake and Biluochun in Dongting Mountain, to working together to solve intangible cultural heritage infringement problems such as Suzhou embroidery and time-honored brands, to promoting the construction of barrier-free maps in Suzhou...... In recent years, the Suzhou procuratorate has actively carried out public interest litigation procuratorial cooperation, expanded the "circle of friends" of co-governance and coordination, not only innovated cooperation mechanisms with water affairs, cultural relics and other departments, and aggregated the protection of food and drug safety, safe production, barrier-free environment construction, agricultural product quality and safety, ecological environmental protection and other fields, but also cooperated with the internet information department to build a comprehensive network governance coordination and cooperation mechanism, strengthen cooperation in information sharing, research and judgment, investigation, disposal and other aspects, and gather a joint force for comprehensive protection of personal information and comprehensive network governance.

There is a linkage between the government and the procuratorate, and there is more coordination between the procuratorate. The cooperation mechanism between the Xiangcheng District Procuratorate of Suzhou City and the Xinwu District Procuratorate of Wuxi City on the protection of ecological environment and resources in the Taihu Lake Basin has promoted the handling of the case of the protection of the Wangting Yuecheng Ruins. The procuratorates of Wujiang District of Suzhou City, Qingpu District of Shanghai, and Jiashan County of Zhejiang Province have realized the "cloud co-governance" of the Taipu River and the Grand Canal through the integrated public interest litigation and procuratorial coordination of the Yangtze River Delta - the six places issued 14 procuratorial suggestions, which have effectively promoted the rectification of issues related to the protection of drinking water sources, illegal discharge of sewage, and garbage piling up along the shoreline.

The procuratorial practice of public interest litigation has gained more vigorous vitality because of "hand in hand".
