Recently, the Ministry of Emergency Management selected and announced 6 cases of safety production reports that were seriously investigated and dealt with in various places.
Case 1: Failure to carry out a review of safety conditions in accordance with the law
In January 2024, the Emergency Management Bureau of Luxi County, Hunan Province received reports from the public, reflecting that the reconstruction project of a high-tech company in Luxi County did not carry out the "three simultaneous" safety evaluation of safety facilities of the construction project. After investigation, the company began to reconstruct the production process and equipment in October 2023, and the production products were changed from red phosphorus to flame retardants (hazardous chemicals), and the safety conditions were not entrusted to an institution with the qualifications stipulated by the state to conduct a safety evaluation of the reconstruction and construction project, and the safety conditions were not reviewed by the safety production supervision and management department, and the report was true. The above behavior violated Article 12 of the Regulations on the Safety Management of Hazardous Chemicals, and the Luxi County Emergency Management Bureau imposed an administrative penalty in accordance with the law.
If the whistleblower discovers and reports the illegal work safety of the production and business operation unit, in accordance with the provisions of the "Luxi County Work Safety Reporting Reward Measures", the Luxi County Emergency Management Bureau will reward the whistleblower with 5,000 yuan in January 2024.
Case 2: Report and investigate the hidden dangers of major accidents in coal mines
In September 2023, the Emergency Management Department of Xinjiang Uygur Autonomous Region received reports from the public, reflecting that a coal mine concealed the number of people going into the mine, and there was a potential danger of major accidents. After receiving the report, the Emergency Management Department of Xinjiang Uygur Autonomous Region handed over the report to the Xinjiang Bureau of the State Mine Safety Supervision Bureau in accordance with the relevant provisions of the Implementation Rules for Rewarding Mine Safety Production Reports (Trial). After investigation, in order to avoid the overtime alarm of the personnel position detection system, each team arranged one person to carry the positioning card of other personnel to ascend the shaft and sign the entry and exit of the well on behalf of the person, resulting in the inconsistency between the actual underground operators and the personnel location detection system and the number of people in and out of the mine record book, according to the provisions of Article 18, Item 5 of the "Coal Mine Major Accident Hidden Danger Judgment Standard", it is a major coal mine accident hidden danger, and the report is true. The above-mentioned behavior violated the provisions of Article 8, Paragraph 2 (15) of the Special Provisions of the State Council on the Prevention of Coal Mine Production Safety Accidents, and the Xinjiang Bureau of the State Mine Safety Supervision Bureau imposed an administrative penalty in accordance with the law.
If the whistleblower discovers and reports the hidden danger of a major accident in the production and business operation unit, in accordance with the provisions of the "Implementation Rules for Rewarding Mine Safety Production Reporting (Trial)", the Xinjiang Bureau of the State Mine Safety Supervision Bureau will reward the whistleblower with 256056 yuan in April 2024.
Case 3: Report and investigate the production of hazardous chemicals without a license
In December 2023, the Emergency Management Bureau of Xiapu County, Fujian Province, received a report from the public, reflecting that a rosin factory in Xiapu County produced hazardous chemicals without a license. After investigation, the rosin factory stored 1 set of relaxed fuel-saving production equipment and 82 barrels of turpentine. After inspection, the turpentine produced by the rosin factory belonged to the flammable liquid listed in the "Catalogue of Hazardous Chemicals" (2015 Edition), and the rosin factory produced hazardous chemicals without obtaining the hazardous chemicals safety production license, and the report was true. The above behavior violated Article 2 of the Regulations on Work Safety Permits, and the Xiapu County Emergency Management Bureau imposed administrative penalties in accordance with the law.
The whistleblower found and reported the illegal act of production safety of the production and business operation unit, and in accordance with the provisions of the "Measures for Rewarding Whistleblowing in the Field of Safety Production in Ningde City", the Xiapu County Emergency Management Bureau rewarded the whistleblower with 15,000 yuan in April 2024.
Case 4: Report and investigate and conceal the accident
In January 2024, the Gansu Provincial Emergency Management Department received a report from the public, reflecting that a new material Co., Ltd. in Qin'an County, Tianshui City, was illegally produced, and a collapse accident caused one death, and it was not reported in accordance with the law, and the accident was suspected of concealment. After investigation, the company had a production safety accident that killed one person in July 2023, concealed the accident that had occurred, and failed to report to the emergency management department and other departments responsible for safety supervision beyond the specified time limit, and the report was true.
If the whistleblower discovers and reports the production and business operation unit's concealment of the accident, in accordance with the provisions of the "Gansu Provincial Measures for Rewarding Work Safety Reporting", the Gansu Provincial Emergency Management Department will reward the whistleblower with 30,000 yuan in April 2024.
Case 5: Report and investigate the failure to design and construct the approved safety facilities
In April 2024, the Emergency Management Bureau of Ningnan County, Sichuan Province, received a report from the public, reflecting that a mining company in Ningnan County did not construct the mine in accordance with the facility design, and there was a potential accident. After investigation, the company's mine did not design and construct the approved safety facilities, and the original stope did not retain the inter-stope pillars and the mine pillars in the mine according to the design, which had major potential safety hazards. The above behavior violated the first paragraph of Article 34 of the "Work Safety Law of the People's Republic of China" and Article 14 of the "Mine Safety Law of the People's Republic of China", and the Ningnan County Emergency Management Bureau imposed an administrative penalty in accordance with the law.
If the whistleblower discovers and reports the illegal acts of production safety of the production and business operation unit, in accordance with the provisions of the "Ningnan County Safety Production Reporting Reward Measures", the Ningnan County Emergency Management Bureau will reward the whistleblower with 20,000 yuan in April 2024.
Case 6: Report and investigate illegal storage of hazardous chemicals
In February 2024, the Tianjin Emergency Management Bureau received a report from the public, reflecting that an industrial and trade enterprise in Beichen District illegally stored hazardous chemicals, which had potential safety hazards. After investigation, diesel fuel and CLEANSOL HS cleaning agent are stored in the warehouse of the enterprise, and the relevant contents of the above-mentioned chemical safety data sheet and the "Catalogue of Hazardous Chemicals" (2015 Edition) and the announcement of 10 departments including the Ministry of Emergency Management of the People's Republic of China (No. 8 of 2022) are hazardous chemicals, and there is a danger of emitting combustible gas and combustible vapor, and the storage site is not equipped with a combustible gas detection and alarm device, which does not meet the "General Code for Building Fire Protection" (GB55037-2022) Item 8.3.3 requires that the report be true. The above behavior violated the provisions of Article 20, Paragraph 1 and Article 32 of the Regulations on the Safety Management of Hazardous Chemicals, and the Beichen District Emergency Management Bureau imposed administrative penalties in accordance with the law.
If the whistleblower discovers and reports the illegal act of production safety of the production and business operation unit, in accordance with the provisions of the "Tianjin Emergency Management Bureau's Regulations on Rewarding Whistleblowers in the Field of Work Safety (Trial)", the Tianjin Emergency Management Bureau will reward the whistleblower with 9,000 yuan in May 2024.
