On April 7, 2018, before the defendant Zhou XX used the cutting machine on the roof balcony of a certain residential area, he knew that the victim Yin XX and others were working at height, and saw that the safety rope used by Yin X was near the cutting machine, but failed to fulfill his duty of care and failed to ensure that the cutting machine kept a safe distance from the safety rope. Zhou Moumou started the cutting machine on the spot to polish the aluminum alloy pipe, causing the safety rope used by Yin to be cut by the cutting machine and fall from the building and be injured.
After evaluation, Yin's injuries were classified as serious injuries of the second degree. The court held that the defendant Zhou caused serious injury due to negligence, and his conduct constituted the crime of causing serious injury by negligence.
