The court held that the defendant Cao Moumou clearly knew that others were in a high-altitude position between the fourth and third floors, but still disregarded the personal safety of others, and used a kitchen knife to cut off others' high-altitude safety ropes, intentionally harming the physical health of others, causing minor injuries, and his conduct constituted the crime of intentional injury. The court found the defendant Cao XX guilty of intentional injury and sentenced him to nine months imprisonment with a one-year probation.
On April 7, 2018, before the defendant Zhou XX used the cutting machine on the roof balcony of a certain residential area, he knew that the victim Yin XX and others were working at height, and saw that the safety rope used by Yin X was near the cutting machine, but failed to fulfill his duty of care and failed to ensure that the cutting machine kept a safe distance from the safety rope. Zhou Moumou started the cutting machine on the spot to polish the aluminum alloy pipe, causing the safety rope used by Yin to be cut by the cutting machine and fall from the building and be injured.
After evaluation, Yin's injuries were classified as serious injuries of the second degree. The court held that the defendant Zhou caused serious injury due to negligence, and his conduct constituted the crime of causing serious injury by negligence. In view of the fact that he voluntarily surrendered, truthfully confessed his crime, and the victim has received part of the financial compensation. The court found the defendant Zhou guilty of causing serious injury by negligence and sentenced him to nine months in prison.
