Announcement of the General Administration of Customs [2024] No. 121 (Announcement on the Phytosanitary Requirements for Importing Popea from Mozambique)

In accordance with the relevant laws and regulations of the mainland and the regulations of the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Rural Development of the Republic of Mozambique on the phytosanitary requirements for the export of Mozambican pigeon peas to China, the import of Mozambican pigeon peas that meet the following relevant requirements is allowed from now on:

1. Basis for inspection and quarantine

(1) The Biosecurity Law of the People's Republic of China;

(2) the Law on the Quarantine of Animals and Plants Entering and Leaving the Country of People's Republic of China and its implementing regulations;

(3) The Food Safety Law of the People's Republic of China and its implementing regulations;

(4) the Law on the Inspection of Import and Export Commodities in People's Republic of China and its implementing regulations;

(5) Measures for the Supervision and Administration of Inspection and Quarantine of Imported and Exported Grain;

(6) Measures for the Administration of Import and Export Food Safety of the People's Republic of China;

(7) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Rural Development of the Republic of Mozambique on Phytosanitary Requirements for the Export of Popea from Mozambique to China.

2. The name of the commodity that is allowed to enter the country

For the purposes of this bulletin, pigeon pea (Cajanus Cajan) refers to the seeds of non-seed pigeon peas grown and processed in Mozambique for food or food processing.

3. Permitted origins

All of Mozambique.

4. Enterprise registration

The Ministry of Agriculture and Rural Development of the Republic of Mozambique (hereinafter referred to as the Mozambican side) shall conduct an audit of the processing enterprises of pigeon peas exported to China and recommend qualified processing enterprises to the General Administration of Customs of the People's Republic of China (hereinafter referred to as the Chinese side). After passing the inspection or review, the Chinese side will register and publish the list of relevant enterprises on the official website of the General Administration of Customs.

5. Pests of concern

The following quarantine pests are not allowed to be carried by pigeon peas exported from Mozambique:

1.大谷蠹Prostephanus truncatus

2.谷斑皮蠹Trogoderma granarium

3.暗条豆象Bruchidius atrolineatus

4.瘤背豆象属(四纹豆象和非中国种)Callosobruchus spp. (maculatus and non-Chinese)

5.大丽花轮枝孢Verticillium dahliae

6.菜豆晕疫病菌Pseudomonas savastanoi pv. phaseolicola

7.豇豆轻斑驳病毒Cowpea mild mottle virus

8.假高粱Sorghum halepense

6. Pre-shipment requirements

(1) Production requirements.

Mozambique should guide pigeon pea producers to establish an integrated pest management (IPM) system and a food safety management system. Adopt internationally recognized investigation and monitoring methods to carry out epidemic monitoring and pesticide use investigation for quarantine pests of concern to China during the growth and storage periods of pigeon peas.

(2) Packaging and transportation requirements.

输华木豆以包装形式运输,采用符合中方要求的新的材料包装。 每一包装应使用英文标注“This product is exported to the People’s Republic of China”(本产品输往中华人民共和国)字样以及产品的品名、产地、加工企业及其注册号、出口商的名称及地址等信息。

(3) Product requirements.

The pigeon peas exported to China shall comply with the requirements of China's plant quarantine laws and regulations and national food safety standards, and shall not contain quarantine pests of concern to China, shall not contain soil, live insects, insect eggs, and shall not be mixed with weed seeds, plant residues, gravel and other impurities.

(4) Pre-export inspection and quarantine and certificate requirements.

出口前,莫方应对木豆实施检验检疫。 对符合要求的货物,莫方根据国际植物检疫措施标准ISPM第12号《植物检疫证书准则》出具植物检疫证书,并在附加声明中用英文注明“This consignment meets requirements of the Protocol of Inspection and Quarantine Requirements for pigeon pea exported from Mozambique to China, and is free of any quarantine pest concerned by China.” (该批货物符合莫桑比克木豆输华植物检疫要求议定书的规定,不带有中方关注的检疫性有害生物),同时注明该批货物的加工企业及其注册号等信息。

If it is found that there are live insects in pigeon peas exported to China, effective quarantine treatment should be carried out before export, and the method, time, temperature, agent and other information of quarantine treatment should be indicated in the plant quarantine certificate.

7. Entry inspection and quarantine

When the pigeon peas exported to China arrive at the port of entry in China, the Chinese Customs shall carry out inspection and quarantine in accordance with the following requirements.

(1) Verification of certificates.

1. Verify whether the "Quarantine Permit for Imported Animals and Plants" has been obtained.

2. Check whether it is from a registered enterprise.

3. Verify whether the attached phytosanitary certificate is true and valid.

(2) Cargo inspection.

1. In accordance with the relevant laws, administrative regulations, rules and other provisions, combined with the requirements of this announcement, the inspection and quarantine of imported pigeon peas shall be implemented. Those who pass the inspection and quarantine shall be allowed to enter the country.

2. Pigeon Peas shall be inspected and quarantined at the supervised sites designated by the Chinese Customs.

(3) Disqualification handling.

1. If there is no valid phytosanitary certificate, it will be returned or destroyed.

2. If live quarantine pests or other live pests are found and there are effective treatment methods, they shall be treated as pesticides; If there is no effective disposal method, it shall be returned or destroyed.

3. If it is found that it does not meet China's food safety requirements, it shall be dealt with in accordance with relevant laws and regulations.

4. If impurities such as soil, plant residues and gravel are found, they shall be harmlessly treated, returned or destroyed in accordance with relevant laws and regulations.

If the above-mentioned violations are discovered, the Chinese side will notify the Mozambican side and take measures to suspend the export of relevant enterprises according to the severity of the violation, up to the suspension of the export of pogeon peas from Mozambique to China.
