Articles 126 and 127 of the "Regulations" set out a negative list of acts that disregard the interests of the masses and make provisions for punishment.
(1) Issues involving the vital interests of the masses, such as production and livelihood, can be resolved in accordance with policies or relevant provisions but are not resolved in a timely manner, and are lazy and inefficient, causing a negative impact. Paragraph 1 of Article 126 of the Regulations stipulates this. Some party members and cadres do not take the interests of the masses seriously and allow the masses to do things in a hurry, but they are indifferent. For example, some work efficiency is low, and the problems reported by the masses can be solved according to the policy but not solved in time, so that the masses often run, which takes a long time; Some of them have a lax style of work, are lazy and procrastinate, and the masses will only move when they push, delaying the production and life of the masses. Party members and cadres must always keep the safety and well-being of the masses in mind, and as long as the affairs of the masses are in line with policies or regulations, they should be resolved in a timely manner without delay.
"Issues involving the vital interests of the masses in production and life" mainly include enterprise restructuring, land expropriation, urban demolition, food and drug quality, production safety, environmental protection and other mass issues. In reality, some of the problems involving the vital interests of the masses, such as production and livelihood, lack a policy basis, or are not allowed by policy regulations, and if they belong to such problems and are not resolved, they will not be punished as violations of discipline.
(2) Responding passively to the demands of the masses that conform to the policy, passing the buck, harming the relationship between the Party and the masses and between the cadres and the masses. Article 126, Paragraph 2 of the Regulations provides for this. In the course of discipline enforcement and supervision, it was discovered that some party members and cadres did not pay attention to the demands of the masses and did not do their best, and when they encountered things, they went around and took responsibility for it, and they were vain and coping, and the masses were very disgusted by this. When handling matters involving the masses, party members and cadres should be more empathetic, put themselves in their shoes, truly take the interests of the masses to heart, take the demands of the masses seriously, and think about what the masses think and be anxious about what the masses are anxious about.
(3) Treating the masses with a vile, simple and rude attitude, causing a negative impact. Paragraph 3 of Article 126 of the Regulations provides for this. In the supervision of discipline enforcement, it was found that some party members and cadres regarded themselves as "official masters", condescending to the masses, difficult to enter, and ugly faces; Some of them have simple and rude working methods, and they treat the masses with a rude tone and arrogance. On the surface, these behaviors are a matter of work attitude, but in essence they are a manifestation of bureaucratic style and privileged thinking. Party members and cadres should profoundly understand that CPC members are always ordinary members of the working people, earnestly implement the party's mass line in their own work, and do a good job in serving the masses with patience and meticulousness.
(4) Engaging in deception, deceiving superiors and subordinates, and harming the interests of the masses. Article 126, Paragraph 4 of the Regulations provides for this. In the course of discipline enforcement supervision, it was discovered that some party members and cadres lied about their achievements or covered up mistakes and mistakes in their work, and some evaded the supervision of the masses and forged or altered financial and accounting materials in the management of village-level affairs, thus harming the interests of the masses. Party members and cadres must persist in seeking truth from facts, seeking truth and being pragmatic in their mass work, realize, safeguard, and develop the interests of the masses with real achievements, and do not allow them to engage in deception, deceive superiors and subordinates, and harm the interests of the masses, no matter what their motives.
This act is different from the provisions of articles 61 and 140 as follows: this act is applicable in the course of handling relations with the masses, harming the interests of the masses rather than other interests; Article 61: Where it is required that there objectively exist major matters that should be requested or reported to the organization in accordance with relevant provisions or work requirements, this conduct does not require that such matters for instructions and reports must exist; Article 140: The conduct must occur during the inspection or inspection work of the higher authorities or during the reporting or reporting work to the higher authorities, and there is no such restriction in this act.
(5) Failure to rescue in case of danger. Article 127 of the "Regulations" stipulates that when there is a serious threat to state property and the lives and property of the masses, and the person who can be rescued but fails to do so, and the circumstances are more serious, he shall be given corresponding sanctions. When party members and cadres encounter a serious threat to state property and the lives and property of the masses, if they have the ability and conditions to rescue or provide assistance, they must not retreat from danger or turn a blind eye, but should rush forward at the critical moment and do their best to protect the safety of state property and the lives and property of the masses from being harmed.
Violations of this article are mainly manifested in passive inaction, which applies to both Party members and Party organizations. If it is a Party member or cadre with a specific identity, specific duties, and specific obligations, who can be rescued but fails to save in the course of performing his duties, and violates the relevant laws and regulations, he may be suspected of dereliction of duty, dereliction of duty, and criminal crimes, and it is necessary to apply the discipline and law convergence provisions in Chapter IV of the General Provisions of the "Regulations".
