The first-instance verdict in the antitrust case of Chinese consumers v. Apple was pronounced: Apple has a dominant market position, but it has not abused it

On May 29, the Shanghai Intellectual Property Court pronounced a judgment in the first instance of China's first consumer lawsuit against "Apple" monopoly, and the court found that Apple clearly had a dominant market position in China's software market, but did not abuse its dominant market position, and rejected the plaintiff Jin's claim.

Dissatisfied with Apple's 30% commission for "in-app purchases", Apple mobile phone consumer Jin (the plaintiff) took Apple and Apple Computer Trading (Shanghai) Co., Ltd. to court on January 11, 2021. According to the judgment, Jin's core demands include stopping the unfairly high price of charging 30% "Apple tax" and stopping the tying of "in-app purchases" to force the use of Apple's payment system.

The plaintiff's lawyer said that he respects the judgment of the court of first instance, but will appeal the case to the Supreme People's Court.
